Nath Network & Telecom Inc. (“CDNShark”, “we”, “us”, or “our”) respects the intellectual property rights of others and responds to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (“DMCA”). This Policy forms part of our Terms and Conditions.
If you believe that content stored on, cached by, or delivered through the Services infringes your copyright, you may submit a written notification to our Designated Agent (details below). To be effective, your notification must include substantially the following:
Upon receiving a valid notification, we may remove or disable access to the allegedly infringing material and will make a reasonable effort to notify the affected customer. Because CDNShark often acts as a network and delivery intermediary, we may forward valid notices to the responsible customer or host, or take other appropriate action.
If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent that includes:
Upon receipt of a valid counter-notification, we may restore the material in accordance with the DMCA unless the original complainant files a court action seeking to restrain the activity.
We reserve the right to suspend or terminate, in appropriate circumstances, the accounts of customers who are determined to be repeat infringers.
Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please ensure your notice or counter-notice is accurate.
