Beta Program Terms

These Beta Program Terms apply to your participation in the CDNShark beta program. They supplement our Terms and Conditions, Acceptable Use Policy and Privacy Policy, which also apply in full. Where these terms conflict with them, these terms govern your beta services.

1. The beta

The beta program lets a limited number of approved users use CDNShark services free of charge before public launch, in exchange for real-world use and feedback. Places are limited and applications are approved at our discretion. Submitting an application does not guarantee a place.

2. Term

Beta services are provided free of charge for 12 months from the date your beta account is activated. Beta services do not renew automatically and you will not be charged for them. We will email you at least 30 days before your beta period ends, explaining your options, including moving to a paid plan.

3. End of the beta period

We may, at our discretion, extend the beta period for some or all testers. Any extension will be confirmed to you by email.

If you do not move to a paid plan by the end of your beta period, your beta services will be suspended. Your data will be kept for 14 days after suspension so you can retrieve it, and then permanently deleted. Keep your own backups; do not rely on beta services as your only copy of anything.

4. Beta services may change

Beta services are pre-release. Features, limits, plans and locations may change, be reset or be withdrawn during the beta. We may need to migrate your VPS, hosting account or data between servers, with reasonable notice where possible. Beta services are provided "as is", without any service level agreement or uptime guarantee.

5. Fair use

Free resources are for genuine use of the services. Without our written agreement, you may not use beta services for:

  • cryptocurrency mining, or other sustained 100% CPU workloads;
  • reselling, sub-leasing or giving others access to beta resources;
  • public proxies, open VPNs or Tor exit nodes;
  • sustained saturation of your network port, or traffic intended to test or attack third parties;
  • anything that breaches our Acceptable Use Policy.

Resources that stay unused for 60 days or more (for example a powered-off VPS or an unused IPv4 address) may be reclaimed after we have emailed you.

6. One account per person

Beta access is personal, limited to one account per person or organisation, and cannot be transferred or sold. The free beta services have no cash value and cannot be exchanged for credit or a refund.

7. Paid extras

Anything outside your beta allowance, such as add-ons, extra resources or domain registrations, is billed at our normal prices.

8. Feedback

We welcome bug reports, suggestions and other feedback. You grant us a free, perpetual right to use any feedback you give us to improve our services, with no obligation to you.

9. Public discussion

The beta is not confidential. You are welcome to discuss, review and share your experience of CDNShark publicly, including on forums and social media.

10. Suspension for abuse or misuse

We may suspend or terminate your account and any or all of your services, immediately and without prior notice, if we believe you have abused or misused CDNShark in any way. This includes, but is not limited to:

  • any breach of these terms, our Terms and Conditions or our Acceptable Use Policy;
  • spam, phishing, malware, botnets, scanning, brute-force attempts or attacks on any network or system;
  • illegal content or activity, or content that infringes the rights of others;
  • activity that harms or endangers our network, our reputation (for example IP address blacklisting) or other customers;
  • creating multiple accounts, giving false application details or attempting to get around beta limits;
  • any other use we reasonably consider abusive.

Suspension for abuse or misuse is at our sole discretion. Beta services suspended or terminated for abuse are not reinstated, and data on them may be deleted without the retention period in section 3. Where the law requires, we may preserve data and report activity to the relevant authorities.

11. Ending your participation

You may leave the beta at any time by closing your account. We may also end your participation for sustained inactivity, with notice by email.

12. Changes to these terms

We may update these terms. If a change materially affects you, we will email you before it takes effect.
